The Official Rules – Earn Your Way to the Breakaway Contest

Except for networks and list partners, each current Affiliate of CPA Empire®, a division of Media Breakaway, LLC (“Media Breakaway”), is eligible to participate in the Earn Your Way to the Breakaway Contest (the “Contest”).  The Contest begins April 1, 2008 and is scheduled to continue through May 31, 2008 (the “Contest Period”), although Media Breakaway may change or discontinue the Contest without notice at any time.  Winners will be announced on or before June 9, 2008.

By enrolling in this Contest, each participant accepts and agrees to be bound by these Official Rules, by CPA Empire’s Terms and Conditions , and by the decisions of Media Breakaway regarding the interpretation of the Terms and Conditions and these Official Rules, which shall be considered final and binding.  Media Breakaway reserves the right to amend these Official Rules, and any amendments shall be effective upon being posted on the CPAEmpire.com or CPAEmpireBreakaway.com websites.

This Contest is based on the amount of total payable Eligible Commissions generated by the Affiliate during the Contest Period.  Enrolled Affiliates who earn at least $5,000 in Eligible Commissions during the Contest Period will be eligible to receive the reward at the prize level described below (“Reward”), subject to these Official Rules.

Level 1
(Earn $5,000 - $9,999 in Eligible Commissions)
1 Full Breakaway Conference Pass

Level 2
(Earn $10,000 – $49,999 in Eligible Commissions)
1 Full Breakaway Conference Pass
Roundtrip Airfare for 1 Person (up to $800)
2 Night Hotel Accommodations for 1 Person

Level 3
(Earn $50,000+ in Eligible Commissions)
2 Full Breakaway Conference Passes
Roundtrip Airfare for 2 People (up to $800/person)
2 Night Hotel Accommodations for 2 People

Eligible Commissions generated are subject to the restrictions set forth in the CPA Empire Affiliate Terms and Conditions, and each Affiliate must remain in good standing in order to earn a Reward.  Certain campaigns may be deemed to not qualify for Eligible Commission for this Contest at the sole discretion of Media Breakaway.  Affiliate accounts registered to different parties may not be combined. Only one Reward may be earned by each Affiliate (i.e. individual and/or company).

Each Affiliate who accepts a reward agrees that Media Breakaway may use his/her name and likeness to post on the CPA Empire website and as part of its other promotional activities without additional compensation, unless prohibited by law.  Affiliates under the age of 18 as of the last day of the Contest Period may be required to provide parental or guardian consent to the Affiliate’s participation in the Contest. 

The Contest is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited or restricted by law.  Federal, state, and local taxes or duties on the Reward are the sole responsibility of the Affiliate earning the Reward.  Affiliates authorize the deduction of said taxes or duties, if any, from the Reward earned to the extent required by law.  All dollar amounts set forth in these Official Rules are in United States dollars.  All Rewards are subject to any applicable third party terms and conditions.  NO CASH VALUE, SUBSTITUTION OR TRANSFER OF REWARDS BY AFFILIATES IS PERMITTED.  REWARDS, INCLUDING, BUT NOT LIMITED TO ANY CONFERENCE PASSES, CANNOT BE GIVEN AWAY OR SOLD TO ANYONE OUTSIDE OF THE WINNING AFFILIATE’S COMPANY.

In the event of noncompliance with these Official Rules, or if the Reward or Reward notification is unclaimed or not accepted, the Reward will be forfeited.

By accepting a Reward, the Affiliate agrees to defend, indemnify and hold harmless Media Breakaway and its owners, employees, agents and attorneys from any claims, damages, etc. that may arise out of or from this Contest, including but not limited to travel to and from and attending the 2008 Breakaway Conference. Any claim or dispute arising from or out of this Contest and these Official Rules shall be governed by the laws of the State of Colorado. Venue for any such claim or dispute shall be exclusively in the Federal or state court in the County of Denver, Colorado.
